But wait, Americans are already saying that.

    So, Senator Ensign, good for you, you did not break the law in Nevada by committing adultery and cheating on your wife. However, you have sacrificed the "moral high ground" you may have thought you once had. And while your wife is apparently is willing to forgive you, frankly, I doubt anyone else is.     I don't know of any way to detect I-140 revocation. Contacting the employer's legal department is the only solution ...

    Recently my I-140 petition for EB2 was denied on educational grounds . The employer opened an MTR/appeal.

    Is it possible to re-file the I-140 petition in EB3 using the same labor certification, while the first I-140 is pending appeal at AAO.

    apparently none of which will open the nef s from a d90
    I have been saving for months I am on a fixed income
    WHAT THE H CAN I DO
    cs3?
    frankly I am ready to sell all my nikon gear and go canon

    Hi All,

    First of all Congrats! to all people who are eligible to file 485 in july..

    i have strage problem..i am not weather its a problem or not..i have filed my GC in 2004 December and you all know that after that the BEC process came in every thing went to BEC's..and i had no hope on that file and i asked my employer to process my GC under PERM process in 2006 april and i got the Labor and I-140 approved in 6 months...and mean while i got the 2004 labor approved in Feb 2007 and asked my employer which one will be the best and he recommended me apply for I-140 for 2004 labor and wait untill the dates become current and he was expecting the 2004 will become current...so we have applied for I-140 for 2004 labor on May 1st 2007 and the status is pending...now my questios is..

    1) Is there is any problem if i use the 2004 labor and apply for I-485.

    2) When attorney file for I-140 did they mention any where in that forms that i do not have any immigration petiton has been submited before?

    3) If they mention no (miss communication) and applied for I-140 for 2004 labor but in fact there is a petition (I-140) submited for me for my 2006 labor.will this be a problem for my 485 approval?

    4) which one will be the best for me to use now 2004 or 2006?

    5) I spoke to my attorney on this and he said as long as you have not filed for 485 for 2006 labor then there is no harm.But i am concernet about that if my attorney (2004 labor) mentioned that i have not submited any immigartion petition when he filed for I-140,which is not correct since i have appled for I-140 for 2006 labor will that be a problem for my I-485 process?

    you help on this is greately appreciated

    My company applied for my L1B petition in 2007 which was approved and I got an L1 visa in Mar 2007 which was valid until Aug 2009. However I traveled to the U.S only in December 2008. Since my L1 visa was expiring by Aug I applied for a L1 extension in May 2009. This was rejected in August due to some confusion with the I-94. So I had to travel back to India in Aug 2009.

    I then applied for a fresh L1 visa based on my company's L1 Blanket petition. I got this new L1 visa in Sep 2009 and returned back to the U.S. This new visa is valid until Sep 2011.

    My question is can I apply for another L1 extension?

    Will my visa duration or stay duration be considered when applying for another extension?
    I have stayed in the U.S on L1 status only from Dec 2008 - Am I not allowed 5 years?

    Also I am not sure whether I have exhausted my quota of extensions. Will my case be considered as 2.5 years the first time and 2 years extension the second time?
    Or will the Blanket visa be considered a fresh start allowing me another extension?

    Also what will happen if I transfer to H1 at this point of time ... will my L1 stay duration or my L1 visa duration be considered when deciding the H1 visa validity?

    Please help with some answers...

    Can you please explain it a bit more clear. I assume that you appled two I485? One for you, with your wife as dependant. And your wife, with you as dependant. Is that right.

    If so which applications should have same A number. I though A number is different for each applicant. And how can your wife and you both have same A number?

    Provided there is no retro . There can be following situations:

    a) 250 equally distributed in Oct, Nov and Dec and the date moves 1 week at a time to 28th May in Dec 10.
    b) 750 in Oct moving the date to 22nd or 28th May and then stuck there till Dec

    Again depending on if USCIS does quarterly SO then in Dec dates may move to Aug 06.

    I think with similar SO as FY2010 the PD will get close to July2007 by the Sep2011 VB. But whether the PDs will move ahead smoothly or in chunks having large periods of inactivity followed by 5-6 month jumps, thats something no one can predict.

    I am on F1 status in US, My parents are green holder..... I am also planinig to do PhD..... can i apply for green card now....?..... If yes..... on what purpose and with what requierments...?

    You can not file GC based on your F1 or your parent's GC. Either you should go for family based or employment based.

    Family based - your parents should have Citizenship (may you need to be under 21)
    Emp based - You need to have job.
    or marry US Citizen.

    Hi
    I filed my I-485 in July last year. My PD is EB2-Feb 2007. I could not file for my wife since she is pursuing her medical residency on a J1 visa with the 2 year HRR requirement.
    My queries are as follows:
    1. For the interfiling to happen does she need to be done with her J1 waiver or even when she is pursuing it as that is a H1B visa?
    2. If I get my green card before she is done with her waiver then can I still file for her later or will her case then be treated as a family based petition?
    I will really appreciate if somebody can provide some insight regarding the same.

    you can file for her I-485 only after she is done with 3 yr J-1 waiver requirement. As far as your second question I don't know the answer.

    What she have now is an approved AP till 2009 december.

    We recently assisted a client from Johannesburg, South Africa, regarding an H-1B specialty occupation visa. He was approved for an H-1B visa, but in order for our client to enter the United States, he must obtain an H-1B visa in his passport. Because the chances of visa issuance vary greatly depending on documentation and individual circumstances, we suggested that he go to the interview at the U.S. consulate very well prepared. We told him to take a certified copy of his entire H-1B package that was filed with the Immigration Service, along with his Form I-797 Approval Notice. We also suggested that he take original birth certificates, marriage certificate, and proof of financial support. He attended the interview this morning and his experience at the U.S. consulate in Johannesburg, South Africa was documented as follows.

    “My wife, myself and our son had our interview at the U.S. Consulate here in Johannesburg this morning, at 9:00am. We duly arrived at 8:30am, had our relevant DS documents checked at the door, took a number, and waited for the “call.” At promptly 9:00am we were called to a booth, where our fingerprints were taken, the DS forms checked with the original I-797 form, and then told to go and sit down again. 10 minutes later, we went back to the booth, had our fingerprints taken again, and that was it. All visas approved, and to pay DHL the delivery costs. No questions asked, no documents asked for, no requirement of proof of copies of documents, nothing. All in all a painless and easy task.”
