HI
1..I would like to know if an employer revokes 140, and if the AC21 is not submitted at the time of NOID...how many days are given by USCIS?
Is it 30 days?
2..If I go to another emplyer and try to do interfile, still I need to file AC21?
And if the new category is EB2(my old application is EB3), still is that ok?
For eg..EB3 title is system analyst, and if I want to go for Eb2 then which could be more apprepriate..?Senior SYSTEM ANALYST

Each month, annual preferences and foreign state limitations are subdivided by the Visa Office into monthly portions based on the applicants reported at consular posts and CIS Offices. If there is a sufficient amount of visas in a category to supply the demand then that category is considered �current� but when the demand over-exceeds the allotted supply of visas the category is considered �oversubscribed.� This is when a visa cut-off date is established, the cut-off date is the �priority date of the first documentarily qualified applicant would could not be accommodated for a visa number.�

In most of the job boards, we see the following employment types:
1. Full Time (this I understand :))
2. Contract - Corp 2 Corp
3. Contract - Independent
4. Contract - W2
5. Contract to Hire - Corp 2 Corp/W2/Independent.
Can someone explain to me what these mean?
What are the differences with taxation perspective?
For someone on EAD, (for AC21), which employment type(s) are preferred?

I had filed my I485 directly at TSC , the address which was listed on my I140 Receipt on June 25th as per the advise given by IO when i called the 800#

yeah the design is good,but mate, in my opinion we should upload orignal illustrations!
i know this (http://www.computerarts.co.uk/tutorials/2d__and__photoshop/diy_vintage_t-shirts) tutorial from a long time.
yeah u probably didn't coppy it, i'm sure u put some effort on at least coloring it, but still it's absolutely the same pirate!
It's one thing to take an idea and develope it, other is just coppy it!!
I'm posting this because i dont think is very fair for me and the other contestants who put more effort on creating a unique t-shirt.
I'm sure u have a crazy imagination, like most f the designers, and u can come up with something really interestings!

Guys,
I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

I have applied I-140 and I-485 on July 2. I think I forgot to attach one experience letters to it. Can I attach it to that I-140 after getting the receipt #? what is the procedure?

My PD is Feb 2008 and my I-140 has been approved the same year. I am on my H-1b 3 yr extension.
If I were to change my job now, will I lose my PD or can the new company refile my new I-140?

My situation is like this:
I have 3 months left in my 6th year of H1B. LC and I-140 got approved and presently my employer has filed for an extension of H1B for 3 years.
Once I get the 3-year extension, can I change jobs? I understand that my GC process resets, and I am ok with that. I am planning to get the H1B (valid for another 3 years) transferred to the new employer and would join them only after they get the I-797 (with 3 year validity)
If my present employer revokes I-140, can I legally stay in the country on the 3-yr H1B (new employer)? Or do I lose my status and have to immediately exit the country? I am not worried about retaining my PD.
Could you pls share your experiences in this and I would request suggestion on this. Request your help.

Yes you have to fill out separate forms. I applied for my parents last october. One of them got it in 10 days and the other took more than a month. It is advisable to get the application in well ahead of your trip

Thanks for the reply. What I understand even there is no position for EB2 currently, EB2 can be filed for future employment.
Do you know anybody who was in the same situation and converted from EB3 to EB2.

Need your advise. I have an approved PERM Labor (2006)
Also filed for I-485 in July 2007, got EAD, AP.
Lately i noticed that my Date Of Birth is incorrect in page 5 of ETA 9089 Labor Form. This error is in section J Alien Information.
How should i correct it? Please advise.
