He can have both types of permanent residence pending at the same time - marriage-based and employment-based. This is very common. The marriage-based filing will probably be approved sooner than the other, because priority dates are so backlogged now.

Australian Immigration Minister Chris Evans announced recently a new agreement between Australia and New Zealand to improve identity checks and border security. Australia and New Zealand recently signed a memorandum of understanding [MoU] to share biometric data, an agreement that will further strengthen our nations' border security. At the Five Countries Conference (FCC) in London a memorandum of understanding was signed between Australia and New Zealand. According to this document, if you switch jobs it IS better to file the AC21 and inform the USCIS, just in case trhe employer decides to reovke the I-140.

This would be a limited portability - AC21. Correct? I'm saying approved I-140 for all practical purposes should serve like a temp GC. Maybe this is far fetched!!!

Can anyone of you please clarify if we can file I-140 under premium process using Substitute labor.
I know that we can file I-140 under premium for the non-substitute labor, and I am not sure if we can file under premium using the substitue labor.

You will have to open a service request (SR) with USCIS after 30 days have passed. Once you open a SR , usually service center will people will call and confirm about the current status and in about 45 days from SR open date they will try resolve the issue. If 45 days have passed, then you will have to take an infopass appointment figure out. Hope this helps!

Few months ago, my company filed for my 7th year extension and USCIS approved the extension for only 8 months instead of 1 year (my I-140 hadn't been approved yet). My lawyers contacted USCIS for clarification and we finally heard back from them. They say that the approval of 8 months is correct and gave no explanation for why it was not for 1 year (which I would have qualified for since my LC was approved when the extension was filed).
Has anyone else experienced a similar thing?
Check with you employer on the validiity of the associated LCA. At the time of your H1 approval, there might have been only 8 months of validity left on the LCA. Other reason could be, assuming you are working for a consulting company, USCIS might have given you an extension till the end of the current project. I have seen several cases where USCIS only gave 6 month extensions because the project PO was only valid for 6 months.

I have a 4.5 years BSEE degree with the following remarks in chronological order:
- Graduated in 1996 after 4.5 years at a non-US University
- 1996, worked 2 years in company A as an embedded software designer

Interesting (?!) situation!
One of my relative is on F1 visa, he wants to marry someone in India. He has applied family based GC. Can he bring that person in India thru a visitor visa here to USA and get married here ?
1. Is marriage between two non-immigrants valid in USA ? Can this marriage be registered here ?
2. Will his greencard process be in jeopardy if he gets married during the AOS wait time ?

I fail to understand one fundamental thing with Immigration , GOP and Dems .
The GOP was againt latino immigration and had workplace raids with ICE agents and Dogs and Armed soilders ( we all know what they did ) . They Lost the elections and everyone said it is the lationo vote that caused their downfall.
Now come the Dems who are just dodging the ball cleverly , with Economy , healthcare , Wars all over the globe and so on and also care little about immigration. At tlest the workplace raids have stopped .
I am not latino and from India , as an outsider and onlooker to the entire immigration drama , I would want to ask what real choices do the latio voters have ? They just came out from the Fire( GOP Days earlier ) to Boiling oil( Dems Days now) and now they are complaining that they want to vote the govt out and bring back the old govt that had them in fire . I mean what is these threats all about , when either party does not seem to be interested in doing anything except for paying lip service ? With the current attitude of both the parties they have to either select Fire or boiling oil .

My application for an H1B change of status has been denied. I am an F-1 student from Colombia and I was offered a job from THe CDC at Atlanta. According with the USCIS report, the petition was denied because I am going to be hired for a staffing company and not directly for the CDC. It will be possible to appeal the desicion ? If yes, what will my sponsor company need to be succesful with this appealing ?

Today, I received an email from USCIS that my EAD application got approved. My receipt date is on the 3rd week of May of 2007. What I don't understand is that the current processing time at NSC for I-765(EAD) for pending I-485 is March 26th, 2007.....
