My 6th year of H1b is expiring in the Sep 26, 2008. I already applied for my H1b renewal and already got the receipt. I'm Eb3 - ROW.
My and my wife also applied for our EAD renewal in jun 1, 2008 (Nabraska). didn't receive anything till now. My wife needs that to continue with her job, we already expedite the process last week.
I also visited home couple of months and and entered Us using my AP.
I have some question regarding all those issues:
1) Can I get a business license when i'm working with the H1b and have the EAD?
2) Does it going to have any effect on my green card process or H1b status?
3) If i have the problem then can i open the business license under my wife's name as she will be in the EAD.
4) My PD is May 2006. Any chance it will be current in next 6 months?
Please give your feedbacks with your expertise guys. it's been very help for long time for me. Thanks ahead

True up to some extent. When filing AOS, you still "intent" to join for the exact same employment (including location), as specified in your LC. You are NOT required to take that exact employment "at the time" of filing AOS. What is required "at the time of filing AOS" is to have a legitimate intention to take that exact employment upon GC. By joining for that exact employment from anytime now, will actually help in proving the "legitimacy" of your intention (but not "required").
My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? It looks as though they have updated their page. Previously they were suggesting people apply 180 days in advance.
You are right a month ago it used to say 180 days as I have a print out and now it say's 120 days...since we are dealing with notorious USCIS who are very popular of doing such silent updates and there won't be any track of updated time stamp or date stamp anywhere on this website...(which is another useless page) I guess they do it on purpose and not sure if you remember recently how they changed dates for NSC & TSC for 140 processing dates etc....

I would say 30 days after August 23 since that is the latest advert you ran for the job.

I'm facing a frustrating issue and am hoping that someone can provide help on this. I'm on my H1 10th year extn. My I-140 (EB-3) was recently approved and I cannot apply for I-485 as the visa dates are not available. My Company recently changed their name from ABC, doing business as XYZ, to DEF, doing business as XYZ (the doing business as part of the name is the same and there was no merger, just a name change).
My first question is does this invalidate my approved I-140 and should I refile the I-140. Also, when I file my H-1 extension what document should I provide to prove the name change (or is it even needed?)? Any help on these 2 questions would be greatly appreciated. Thanks.

TSC processing times for Feb is out.
I-485 has advanced to 18th July 07.

Any idea with whats going on with TSC Processing times, my PD is current Nov' 2003, however do not see any movement in the processing times, 485 applied on Aug 7, 007, any idea when they will publish the new processing times? Any way we can know where we are in the 485 proccess?

Please help me on this question
I was on F-1 Visa in 2003 I applied for the labor certification through a friend's company- call it Company- A, on the intention to to work in his company as a Network administrator. I got my labor approved and I -140 is approved too. The priority date is december 2003. All these years I was waiting for my priority date to become current.Currently I work for Company B with same job title and credentials. I have an H-1 from company B.
What do you suggest
1) Shall I go ahead and apply for the I 485 from company A (company A is willing to help). Can INS ask for the pay stubs? Becoz I never actually worked at my friend's company.
2) It will take 3-4 months for company B to finish doing my labor certification and apply for my I -140. But it would be too late for the priroty date. (It may retrogress).
3)I understand that once my current company's I -140 is approved i can request to keepo my previous priority date
what shall i do now in july/august.

A federal judge in Phoenix on Wednesday blocked key provisions of Arizona's controversial immigration law from taking effect as scheduled Thursday, granting in part an injunction requested by the Obama administration.
U.S. District Judge Susan Bolton ruled that the injunction would apply to the portion of the state law that requires police to try to determine the immigration status of a person they arrest, stop or detain while enforcing other laws if they reasonably suspect the person is in the United States illegally.
In a lawsuit filed against Arizona, the Obama administration said the law was unconstitutional and warned that the provision would result in racial profiling and harassment of U.S. citizens, legal immigrants and foreign visitors.
Bolton said in her ruling that it was "not in the public interest" for Arizona to enforce a provision that preempts federal enforcement of immigration law.
