Good morning! Please clarify for my case details given below :
Labor approved, I140 denied for ability to pay. Employer had filed MTR with current tax returns documents. The labor has been filed & approved less than 180 days and I140 pending with MTR. H1B expires in 15th May 2011 completing all six years and no recapture periods left.
The questions are:
1. Can I file an extension of H1 with pending MTR and with less than year old labor application?
2. Is it legal to stay in US after May 2011 while MTR is pending and H1 extension is filed before expiry?
3. In case, if the MTR is denied, would the illegal/out of status will start from 15th May 2011 or from the date the MTR is denied?

To everyone who reads my post. I apologize for not being clear. The article says that they are talking about eliminating the per country caps and giving green cards to STEM graduates. In my haste and excitement I should have spelled this out. Now with that said I do not appreciate the snide remark from the previous poster. This is a forum for productive discussion, not for people to be condescending. So let us rejoice that maybe people are listening to us!

My friend has a question. His wifes H1 got approved. As of now she doesnt have job. What if she gets job in dec/Jan. There wont be any pay roll for october and november. Will this create any problem at the time of visa stamping in India if she goes for vaction later in next year.
Is there any time limit to Start working after october.

Please note that an I-485 approval invalidates the H-1B visa.
I would travel to the US before Advanced Parole expiry to obtain the GC and return. I am not sure of any exceptions - please post the question in 'Ask a Lawyer' section ASAP.
I second what sbmallik has said. Your records will be at the POE, you cannot come back on H1-B. Come back before AP expires or you might be in trouble.

I think most people think immigrants steal their jobs, but the truth is sometimes we struggle to hire a local person and then a foreigner walks in with the skills we need, but we can't hire him. (this is not to say we have not had good quality local people for the job as well)

option 3 as far as I know. You only renew the 6 year term if you are out of the US more than a year. And once you switch to a different visa category, your previous one does not matter for the cap. Its only if you are transferring from an existing H1B or renewing an existing H1B that the cap doesn't come into the picture.

We are thus not discussing the list he is on, but are simply taking note of the Senator's credibility on an issue that affects us. Anything beyond that would be inappropriate and not relevant to our issues.

Quick survey to findout how many people like the idea of having their passports restamped here in USA and avoid all the surprises and shocks. This doesn't need any legal fixes. It is a convenient measure for everyone. Besides it was an old practice that was stopped for "security" reasons or some crapp. It is a small step but helps with any cases like family emergency or some urgent business need to travel abroad.
Based on the poll results and suggestions, we can comeup with a strategy to address the issue.

I dont think you will need them . I am also filing premium 140 and lawyer has nOT asked for all I94s ..ONly the recent one..Dont worry much if you dont have all of them

Has anyone tried extending NJ DL using H1b extension receipt ?
My H1b extension is in VSC and looks like it will take long long time to come back....DL is expiring in 30 days, with EAD my renewal would be for 6 months only as EAD also expires in Aug.
wonder if they will accept H1b receipt with employer letter ?
please share your NJ DL experience.

We also handed our H1/H4 receipts, but she handed those back to us. I would think that they will need the approval notices just to figure out the validity of the new license they will issue.
I guess you can show them your EAD document and try to get a renewal for couple of months, I am not sure though.

I have an h1b stamped in passport that expires in july 2011. However, it is totally unused because i had to leave my company for higher studies in 2009. Now, i am joining the same company again in may 2011 after studies.
1.Is visa extension for 3 years possible in such case..?
2. Will there be any problem because of not using the visa at all till now..?
3. Is there a minimum time limit after joining aftre which only I can apply for extension..?
4. Most important, can i apply for extension even after expiry of visa in july,2011...??
