I was in a similar situation as you and had to use this firm. H1B filing experience was fine but the entire GC process and filing was not a good experience at all. There were days I had to call the paralegal and teach him the new immigration laws and that's never a good sign ! Because of their mistake I was stuck in Eb3 rather being in Eb2. May be they will deal differently with your case but have a chat with them and your company managers before you agree to use them. I m with another company and another attorney firm and they are awesome !

YOu can transfer to Company C, if you are still working with Company A use the same documents for transfer and not the company B.

My pending I-140 (filed an year ago...June 2006) was transferred from TSC to NSC on 09/05/2007, because my I-485 was filed with NSC. What date willl NSC use as received date to process my case...the date they received from TSC or the original receipt date?
Isn't it(140 filed at TSC almost an year ago) supposed to be certified by now?
TSC has been much faster at certifying 140s . Looks like USCIS is transferrring the 140s from TSC ... I can only pray for alll concurrent fileres that filed at TSC ...
140s at NSC are almost taking an year according to latest processing times.

Please update your case if you have applied on July 2nd at NSC and your case got transferred to TSC later..

I am currently working for big consulting firm, they hold my H1 and 485 is pending for more than 6 months. i have valid EAD from pending 485.
I am getting full time opportunity, my new employer is ready to transfer H1 as well as they are willing to accept me using EAD. so its entirely my preference.
can you please tell me adv/dis adv of using H1 over EAD or vice versa. (my 6 yrs of H1 will finish in another 6-7 months)

How do you know that your case has been transferred from NSC to TSC.
Receipt has address of issuing office at the bottom of it. I also had nothing showing up in the system until yesterday, but today, our EAD's are in the system, but not I-485 or I-131. Perhaps EAD is considered a priority.

I am currently on h1b, I am planning to join a new company and I qualify for EB2 category.

Does anybody know which ASC in the bay area allows walk-ins? I missed my appointment and need to get this thing taken care of before I travel (I'm going to be out of the country Jan-Feb).
I tried walking into the San Jose center but they asked me to reschedule my appointment. I'd appreciate any advice.

I understand there will be stress headache etc... I just wanted to see if the cost of appealing a wrongly rejected 485 was something a H1b employee can afford.
BTW on lighter note:
For headache I use zandu balm
and for stress I do Yoga.
These dont cost as much as docs/lawyers in this country!!

I got my visa H1B from employer X in the year 2003 and travelled to US in jan 2004 immigration officials denied my port of entry saying employer X is non-existent and cancelled my visa and told to with draw my application and they have written 212(a)(c)(i)(i) on my passport.I went back to my home country and worked over there for 3 yrs. After sometime i got an offer from some employer Y,they have filed for my H1B and approved.
When i went for visa to US Consulate visa officer told me that am ineligible for the H1B visa. I have explained them what exactly happened in 2004.
VisaOfficer has asked to appeal for waiver using the form I-601,after my appeal to the USCIS, consulate has given the visa.I came to US in 2007 and working for same employer B .I applied for extension under the same employer B,got an RFE asking to submit aggrement b/w the client and the vendor,the requested documents are sent. After that USCIS sent NOID(Notice of Intent to Deny),gave the reason as :
In January 2004 the beneficiay applied for admission as an H1 B Worker for company X.Under oath the beneficiary stated he never signed a contract with the petitioning company X,the petition company was found not to exist. Therefore, the beneficiary was found inadmissible under 212(A)(6)(C)(I) and 212(A)(7)(A)(I)(I) and permanently ineligible for the H1 Classification.
USCIS has again came back with the same issue of my previous H1 B.
I have been in US from 2007 June with employer Y ,after going through all the process in the year 2007 USCIS has issued my visa.
Please advice me on this, any help fully appreciated.

You don't need an EAD to study full-time. Only if you are planning to work as as a graduate assistant while you study would you need an EAD. You are already in valid parolee status.
